ALL PARTICIPANTS PLEASE READ:

ALL PARICIPANTS, PLAYERS AND ATTENDEES MUST READ AND AGREE TO THIS RELEASE OF LIABILITY, ASSUMPTION OF RISK, MEDIA RELEASE AND EVENT RECORDINGS AGREEMENT BEFORE REGISTERING, PARTICIPATING IN THIS EVENT. PLEASE READ AND UNDERSTAND THE RISKS BEFORE REGISTERING FOR THIS EVENT.

In consideration of being allowed to participate or attend, in any way, in the FWC26 MIAMI HOST COMMITTEE COPA DEL SOL TOURNAMENT, its related partner activities, engagements and any related events (collectively, the “EVENT”), you acknowledge, appreciate, and agree that:

  1. The risk of injury from the activities at this Event is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
  2. YOU KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES (defined below) or others, and assume full responsibility for your participation; and,
  3. YOU willingly agree to comply with the stated and customary terms and conditions for participation. If, however, you observe any unusual significant hazard during your presence or participation, you will remove yourself from participation and bring it to the attention of the EVENT OPERATORS immediately; and,
  4. YOU for yourself and on behalf of your heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS ALL EVENT OPERATORS, PARTNERS, ORGANIZERS, TEAM OWNERS, AFFILIATES OR ANY INDIVIDUAL OR ORGANIZATION AFFILIATED WITH THE EVENT including their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the (collectively, the “Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
  5. The Terms and Conditions of the Plei App, provided HERE (https://www.plei.com/terms/terms-conditions), are incorporated herein by reference. All registered participants and attendees of this Event, upon checking the box and registering via the Plei App for the Event, are hereby also agreeing to such Plei Terms and Conditions, notably and including Section 8 (MEDIA RELEASE AND EVENT RECORDINGS).

By participating in the Event, you hereby acknowledge and agree that Plei and its Partners may document, film, photograph, record and capture your name, image, likeness, voice, photograph, video, and biographical material (collectively, “Likeness”) during the Event (collectively, “Event Recordings”).

You irrevocably and perpetually grant Plei and its Partners, their agents, and assigns, a worldwide, royalty-free, perpetual, sublicensable and transferable license to use, reproduce, modify, distribute, translate, and commercialize your Likeness and the Event Recordings capturing your Likeness for any purpose related to Plei’s and the Partners’ businesses, including without limitation, for the purpose of promoting other events, platforms, brands, products, services, promotions, offerings or deals offered by Plei and its Partners. This includes but is not limited to inclusion of your Likeness in blog posts, social media, photographs, e-newsletters, digital assets, paid ads, and other promotional materials without further notification or compensation, in accordance with applicable laws. You hereby confirm that you have the necessary rights and permissions to grant this authorization.

If you provide photos and/or recordings to us, you represent that you have obtained all necessary consents from individuals depicted and grant Plei and its Partners the same rights described above.

You irrevocably and perpetually waive and all legal and equitable claims related to the use of your Likeness, including, but not limited to, claims for copyright or trademark infringement, moral rights violations, defamation, invasion of privacy, violation of publicity rights, or any similar claims under any legal theory now known or developed in the future, arising from the Event Recordings and the use of your Likeness.

This waiver and release applies to Plei and its Partners, and is binding upon you and your heirs, successors, and assigns.

YOU HAVE READ AND AGREE TO THIS RELEASE OF LIABILITY, ASSUMPTION OF RISK, MEDIA RELEASE AND EVENT RECORDINGS AGREEMENT AND YOU FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT YOU HAVE GIVEN UP SUBSTANTIAL RIGHTS BY PROCEEDING WITH REGISTRATION. BY PROCEEDING, YOU ARE AGREEING TO THESE TERMS FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
